Access to the Imagin portal and to information regarding any of the products and services offered by Imagin therein implies acceptance of the conditions set out in this Legal Notice. We therefore recommend you to read it carefully if you intend to access and make use of the information and services that appear or are offered in the Imagin portal.

The information contained in these pages is correct at the time of the last update.

These terms and conditions have been in force since they were last updated. Imagin reserves the right to modify them at any time, in which case they will come into force from the date of their publication and will be applicable to all users of the Imagin portal from that date.

The content of any of the website pages, especially information and publicity, does not constitute a binding offer, unless expressly stated otherwise. Imagin reserves the right to make modifications to or omit all or part of the current content when it deems it appropriate, and to prevent or restrict access temporarily or permanently.

Imagin may include third-party content and links to third party websites, such as social networks and other information, in the Imagin portal, always with the authorization of their owners. Under no circumstances will Imagin be responsible for third-party pages and their content, their functioning or their availability.

Simple browsing through the Imagin portal is free of charge and does not require the user to register in advance. Accessing, contracting or using the products or services offered by Imagin requires the user to download the Imagin app and, as appropriate, accept the terms and conditions governing products and services, each of which will be governed by its own conditions, notwithstanding the terms and conditions specified herein.

The Imagin portal offers the user the option to customize pages, including different screen backgrounds, or configure access to the products and services that Imagin markets, to make browsing and locating resources more efficient and functional, according to individual preferences.

The Imagin portal has been awarded the necessary security and quality certificates, seals and accreditations to provide a secure environment for users.

Imagin complies fully with current legislation on personal data protection.

Imagin has deployed appropriate technical measures to ensure an acceptable level of security, depending on the nature of the personal data processed and the circumstances of the processing, with the aim of avoiding, as far as possible and using the most advanced technological resources available, the modification or loss of such data or unauthorized use of or access to them.

When personal details are requested for the completion of a form, the user will be informed of the identity of the data controller, the purpose for which the data is being collected, the basis of authorization and the user's entitlement to exercise the rights provided for in data protection regulations.

The Imagin portal uses cookies, small files stored on the user's terminal which permit our systems to record browsing patterns or preferences. Imagin uses them to personalize access in successive visits, make browsing more secure, collect statistical information and learn about user preferences.

The Imagin portal's cookies policy conforms to current EU and Spanish legislation regarding data protection and information society services. As required by this legislation, Imagin will inform you of the cookies it uses in the Imagin portal and, when necessary, will request your permission to use them.  

The Imagin portal can be used on mobile devices but in this case the presentation and contents may not be identical.

The Imagin portal, the pages it comprises and the information and other elements contained therein include texts, documents, photographs, drawings, graphic representations, databases, software and also logos, brands, trade names and other distinguishing marks protected by intellectual or industrial property rights, of which Imagin is the holder or legitimate licensee.

Imagin is not answerable for the legality or illegality of the information or elements contained in the Imagin portal, if the relevant rights are not held by Imagin.

Any use, including reproduction in any form, distribution, transmission to third parties, public communication or conversion, using any medium, involving the aforementioned items, creative work and identifying marks is prohibited without the prior express consent of the parties holding the respective rights. Failure to observe this prohibition may constitute an offence punishable under current legislation.

However, on their own account and at their own risk, users may download or make a copy of these elements exclusively for their personal use, provided that they do not infringe any of Imagin's intellectual or industrial property rights. In particular, these items may not be altered, modified or deleted, either wholly or in part. In no case will this mean that the user has been granted an authorization or licence in connection with Imagin's intellectual property rights.

Except in cases where it has been expressly authorized by Imagin, it is forbidden to create links or hyperlinks from third-party portals or websites to Imagin website pages other than the home page of its portal, or to present Imagin website pages or the information contained in them within frames or associated with distinguishing signs, brands or corporate or commercial names belonging to another person, company or entity.

Imagin does not provide any financial information or operations of any kind, nor does it provide investment recommendations or advice on legal or tax matters. 

Any financial information or financial operations will be provided by suppliers for whom Imagin acts as a non-financial agent. These are as follows:

• Financial services are provided by CaixaBank, S.A., with registered office at Calle Pintor Sorolla 2-4, 46002 Valencia, and Tax ID number A08663619, listed in the Mercantile Register of Valencia, Volume 10370, Folio 1, Sheet V-178351, and listed in the Special Administrative Register of the Bank of Spain, under number 2100.
   
• Electronic money services are provided by CaixaBank Electronic Money, EDE, S.L., with registered office at Calle Caleruega 102, Madrid, with Tax ID Number B65866105, listed in the Madrid Mercantile Register, Volume 36639, Folio 1, Sheet M-657263, Entry 1, holder of an authorization from the Ministry of Economy and Finance and subject to supervision by the Bank of Spain.

The information is of a general nature and does not take into account specific investment criteria or objectives or specific financial situations. The information contained must not, therefore, be used to make investments or take decisions regarding them.

Imagin does not guarantee continuous access to or the correct display or download of the elements and information contained in the Imagin portal, which may be impeded, disrupted or interrupted by factors or circumstances beyond its control.

Imagin is not responsible for information or any other content in spaces or websites belonging to third parties, which are accessible from its website via links or hyperlinks, or information and other content in third-party spaces and websites where there are links or hyperlinks to the Imagin portal, or information and any other content on any third-party site which is similar in appearance to Imagin or uses its identifying signs, unless express authorization has been granted by Imagin.

Imagin and its information providers, as third parties, do not assume any responsibility for the information, content of any type, products and services marketed through the Imagin portal by third parties, especially, for damages of any kind that may arise from: (i) information for users which is missing, incomplete, untrue, inaccurate or insufficient; (ii) failure to comply with contracts or pre-contractual relationships or unsatisfactory or late fulfilment of the same; (iii) breaches of the obligations incumbent on information society service providers; (iv) infringement of the rights of consumers and users; (v) infringement of intellectual and industrial property rights; unfair competition or unlawful advertising; (vi) infringement of data protection rights, professional secrecy and the rights to honour, personal and family privacy and self-image; (vii) in general, the breach of any laws, customs or codes of conduct that are applicable and (viii) any decision based on the information provided via the Imagin portal.

Neither Imagin nor the information providers, as third parties, assume any responsibility for damage, losses, claims or expenses resulting from: (i) interference, interruptions, failures, omissions, telephone breakdowns, delays, blockages or lost connections in the electronic system, caused by defects, overloads or errors in telecommunication lines and networks, or by any other factor beyond the control of Imagin; (ii) unlawful intrusion through any means of communication, using malware of any kind, computer viruses or any other method; (iii) improper or inappropriate use of the Imagin portal; (iv) security or browsing errors caused by a malfunction of the browser or by the use of outdated versions of the browser.
 

These general terms and conditions are governed by Spanish law.
